Section 90.91 - RequirementsA person who conducts coal refuse disposal activities shall comply with the performance standards and design requirements of this subchapter, except as follows:
(1) Disposal of coal refuse in an active surface mine shall comply with the performance standards set forth in Chapter 87 Subchapter D (relating to surface coal mines: minimum requirements for operation and reclamation plan) and §§ 90.125 and 90.128 (relating to coal refuse disposal: construction requirements; and coal refuse disposal: active surface mines).(2) Disposal of coal refuse in an abandoned or active underground coal mine shall comply with the requirements of Chapter 89 (relating to underground mining of coal and coal preparation facilities).
