Section 90.146 - Other transportation facilitiesRailroad loops, spurs, sidings, surface conveyor systems, chutes, aerial tramways or other transportation facilities within the proposed permit area shall be designed, constructed or reconstructed, and maintained and the area restored, to:
(1) Prevent, using the best technology currently available:(i) Damage to fish, wildlife and related environmental values.(ii) Additional contributions of suspended solids to streamflow or runoff outside the permit area. Contributions may not be in excess of limitations of State or Federal law.(2) Control and prevent, to the maximum extent possible, diminution of water quantity and prevent pollution.(3) Control and prevent, to the maximum extent possible, erosion and siltation.(4) Control and prevent air pollution.(5) Prevent damage to public or private property.The provisions of this § 90.146 adopted December 19, 1980, 10 Pa.B. 4789, effective 7/31/1982, 12 Pa.B. 2382; amended July 30, 1982, 12 Pa.B. 2473, effective 7/31/1982, 12 Pa.B. 2382; corrected March 1, 1985, effective 11/13/1982, 15 Pa.B. 779.
