Section 90.126 - Coal refuse disposal: burning(a) The person conducting the coal refuse disposal activities shall take immediate action to extinguish any fires or hot spots in accordance with a plan approved by the Department and the Mine Safety and Health Administration. The plan shall contain, as a minimum, provisions to ensure that only those persons authorized by the operator, and who have an understanding of the procedure to be used, shall be involved in the extinguishing operations.(b) Coal refuse may not be deposited on or near any portion of a coal refuse disposal area known to be burning.The provisions of this §90.126 adopted December 19, 1980, 10 Pa.B. 4789, effective 7/31/1982, 12 Pa.B. 2382; amended July 30, 1982, 12 Pa.B. 2473, effective 7/31/1982, 12 Pa.B. 2382.
