Section 89.58 - Pollution-forming materialsDrainage from pollution-forming underground development waste and spoil, if any, into groundwater and surface water shall be avoided by:
(1) Identifying, burying and treating, when necessary, waste and spoil which, in the judgment of the Department, may be detrimental to vegetation or may adversely affect water quality if not treated or buried.(2) Preventing water from coming into contact with pollution-forming materials in accordance with measures required by the Department.(3) Disposing of the pollution-forming underground development wastes in accordance with Chapter 90 (relating to coal refuse disposal). Temporary storage of the materials may be approved by the Department upon a finding that storage will not result in any material risk of water pollution or other environmental damage. Storage shall be limited to the period until burial or treatment first becomes feasible. Pollution-forming underground development waste and spoil to be stored shall be placed on impermeable material and protected from erosion and contact with surface water. Any discharge shall conform with § 89.52 (relating to water quality standards, effluent limitations and best management practices).The provisions of this § 89.58 adopted July 30, 1982, 12 Pa.B. 2473, effective 7/31/1982, 12 Pa.B. 2382.
