Section 88.203 - Disposal of excess spoil: bank reject material(a) The applicant shall demonstrate that the bank reject material can be placed and graded to AOCs or an approved alternate design plan, which will conform to adjacent topography and be free of any polluting hazards.(b) Bank reject material shall be disposed of in such a manner that the area, as it is being backfilled, is free of voids and depressions within the dictates of sound engineering.The provisions of this § 88.203 adopted December 19, 1980, 10 Pa.B. 4789, effective 7/31/1982, 12 Pa.B. 2382.
