Rule 1243 - Shelter Care RehearingsA.Mandatory Rehearing. If the guardian submits an affidavit to the county agency alleging that the guardian was not notified of the shelter care hearing and that the guardian did not appear or waive appearance at the shelter care hearing, a rehearing shall be held within seventy-two hours of the submission of the affidavit.B.Discretionary Rehearing. The court may grant a rehearing upon request of a party or on its own motion.C.Forum. The judge, who heard the original shelter care hearing or adopted the findings of the juvenile court hearing officer, shall hold the rehearing, unless the judge assigns the case to a juvenile court hearing officer.The provisions of this Rule 1243 amended April 6, 2017, effective 9/1/2017, 47 Pa.B. 2313.
