Section 17.11 - Public utility names(a) In section 1303(c)(1)(iv) of the BCL (relating to corporate name) it is provided that the name of a business corporation may not imply that the corporation is a public utility corporation, as defined in the BCL, furnishing electric or gas service to the public, unless the corporation or proposed corporation has as an express corporate purpose the furnishing of service subject to the jurisdiction of the Pennsylvania Public Utility Commission or the Federal Energy Regulatory Commission.(b) In section 5303(c)(1)(iv) of the NPCL (relating to corporate name) it is provided that the name of a nonprofit corporation may not imply that the corporation is a public utility as defined in 66 Pa.C.S. § 102 (relating to definitions).The provisions of this § 17.11 adopted June 22, 1973, effective 6/23/1973, 3 Pa.B. 1164; amended April 17, 1992, effective 4/18/1992, 22 Pa.B. 1993.
