Section 145.98 - Variances from this chapterAn interested person may request the Department to grant a variance from the requirements of this chapter as applied to the person. The person shall furnish the Department with the information pertaining to its request for a variance as the Department may deem necessary for an informed decision. The variance may be granted by the Department only if the following conditions have been met:
(1) The Department determines that granting the requested variance would not impair the health, safety and welfare of consumers and would be consistent with the purposes of the act and this chapter.(2) The request for the variance has been reviewed and approved by the Industrialized Housing Advisory Commission established under section 8 of the act (35 P.
