The Agency may waive or vary particular provisions of this subpart:
(1) To conform to the requirements of the United States Department of Housing and Urban Development or the United States Department of Agriculture in connection with any housing development with respect to which Federal assistance is sought; or(2) In exceptional circumstances, under an emergency situation, or if, in the determination of the Agency, the application of a provision to a specific case may result in the undue hardship.
