Section 584-210-0151 - District Substitute Teaching License
(1)Purpose of the License: The District Substitute Teaching License is a license that permits a qualified individual to substitute teach in prekindergarten through grade 12 Oregon public school districts, education service districts, and charter school assignments with the restriction that the individual must obtain and maintain district sponsorship.
(2)District Sponsorship: The District Substitute Teaching License requires a sponsoring district, which must be an Oregon school district, education service district (ESD), or charter school.
(a) The sponsor must submit a statement at the time of application for the license explaining the district's need for the district substitute.
(b) By submitting a letter of sponsorship for the applicant for a District Substitute License, the sponsor is assuring the Commission of the following:
(A) The applicant meets the qualifications to hold the license;
(B) The district will obtain the license for the educator prior to assignment within the district or prior to the 91st day after the date of application for licensure;
(C) A designated administrator will provide training, guidance, and supervision of the educator to support the educator's service in the assigned schools; and
(D) The district will determine the educator's interest in pursuing a teaching career and provide guidance in this pursuit.
(c) Upon request of the Commission, the district shall submit documentation of the district's plan for administrator support of the educator, as required by this subsection, including the name of the administrator responsible for providing this support.
(3)Renewal of District Sponsorship: Upon renewal of the District Substitute Teaching License, the sponsor must provide a new statement confirming the continued need for the substitute.
(4)Transfer of District Sponsorship: To transfer sponsorship of the District Substitute Teaching License to another district or charter school, the new sponsor must:
(a) Submit a statement as provided in section (2);
(b) Submit a statement that the original sponsoring district has been informed of the transfer; and
(c) Require the applicant to submit a complete and correct application in the form and manner required by the Commission, including payment of all required fees as provided in OAR 584-200-0050.
(5)Assignment Authorization: The District Substitute Teaching License qualifies the teacher to accept substitute teaching assignments only within the sponsoring district.
(a) If the holder of a District Substitute License wishes to accept an assignment in a different district or charter school from the sponsoring district, the licensee must apply for a transfer as provided in section (3) of this rule.
(b) If the holder of a District Substitute License wishes to accept assignments in districts, ESDs or charter schools in addition to the sponsoring district, the license holder must apply for, be sponsored by, and hold a District Substitute License for each district, ESD or charter school.
(c) Any single assignment on the District Substitute License may not exceed 10 days consecutively under any circumstances.
(6)Term of Licensure: The District Substitute Teaching License is valid in accordance with the following provisions:
(a) For applications received from July 1 through December 31, the first District Substitute Teaching License is valid through June 30 of the school year for which it is issued.
(b) For applications received from January 1 through June 30, the first District Substitute Teaching License is valid through June 30 of the following school year unless otherwise requested by the sponsoring district;
(c) If the District Substitute Teaching License is renewed with the same sponsoring district, the renewed District Substitute Teaching License is valid for three years. The license will expire on June 30 of the third academic year following the issuance of the license. The District Substitute Teaching License may be continuously renewed if the applicant maintains an active District Substitute Teaching License with the original sponsoring district and meets the requirements of subsection (7) of this rule.
(d) If the District Substitute Teaching License expires or the applicant obtains a new district sponsor, the applicant will be issued a first District Substitute Teaching License as provided in subsection (5)(a) and (5)(b) of this rule.
(7)Qualifications: To be eligible to apply for a District Substitute Teaching License, an applicant must:
(a) Provide a statement from the sponsoring district in accordance with subsection (2) of this rule
(b) Possess the personal qualifications for licensure including attainment of at least eighteen years of age and possessing good moral character and mental and physical health necessary for employment as an educator;
(c) Meet one of the following as assured by the sponsorship letter:
(A) Demonstrate enrollment in a teacher preparation program; or
(B) Be identified as a student teacher within the sponsoring school district, education service district or charter school; or
(C) Have completed a minimum of one (1) year of experience as an Instructional Assistant, Educational Assistant, or other supporting role in a classroom as an employee of the sponsoring district.
(D) At the discretion of the district or charter school, and with approval of the Executive Director or designee, be a member of the community with sufficient experience as to qualify them for this provisional license.
(d) Meet the requirements for knowledge of U.S. and Oregon civil rights laws and professional ethics;
(e) Complete a background clearance that includes:
(A) Furnishing fingerprints, if required;
(B) Providing satisfactory responses to character questions in the form and manner prescribed by the Commission; and
(f) Submit a complete and correct application in the form and manner required by the Commission, including payment of all required fees as provided in OAR 584-200-0050.
(8)Renewal Requirements: To be eligible to apply for reissuance of the District Substitute Teaching License, an applicant must:
(a) Provide a statement from the original sponsoring district in accordance with subsection (3) of this rule; and
(b) Submit a complete and correct renewal application in the form and manner required by the Commission, including payment of all required fees as provided in OAR 584-200-0050.
