This subdivision applies to all occupational exposures to beryllium in all forms, compounds, and mixtures in general industry and construction activities, except for the following:
(1) This subdivision does not apply to articles, as defined in the Hazard Communication standard (HCS) §1910.1200(c), that contain beryllium and that the employer does not process.(2) This subdivision does not apply to materials containing less than 0.1% beryllium by weight where the employer has objective data demonstrating that employee exposure to beryllium will remain below the action level as an 8-hour TWA under any foreseeable conditions.Or.
