Section 333-120-0545 - Disposal of Certain Byproduct Material(1) Licensed material as defined in subsections (c) and (d) of the definition of byproduct material outlined in OAR 333-120-0015(14) may be disposed of in accordance with 10 CFR Part 61 even though it is not defined as low-level radioactive waste. Therefore, any licensed byproduct material being disposed of at a facility or transferred for ultimate disposal at a facility licensed under 10 CFR Part 61 of this chapter must meet the requirements of OAR 333-120-0550.(2) A licensee may dispose of byproduct material as defined in sections (c) and (d) of the definition of byproduct material outlined in OAR 333-120-0015(14) at a disposal facility authorized in accordance with any federal or state solid or hazardous waste laws including the Solid Waste Disposal Act as authorized under the Energy Policy Act of 2005.Or.
