Section 710:10-13-2 - Requirements for qualification of certain assets for valuation exclusion

An eligible facility must be one which:

(1) Is a "facility, device or method for the desulphurization of gasoline or diesel fuel"including any device or method for the desulphurization of gasoline or diesel fuel, including any structure, building, installation, excavation, machinery, equipment, or device and any attachment or addition to, or reconstruction, replacement, or improvement of that property, that is used, constructed, acquired, or installed on or after January 1, 2003; and

(2) Is used, constructed, acquired or installed wholly or partly to meet or exceed rules adopted by the Oklahoma Environmental Quality Board or by the United States Environmental Protection Agency with respect to any program which has been delegated to the Department of Environmental Quality for the prevention, monitoring, control, or reduction of the amount of sulfur in gasoline or diesel fuel. 68 O.S. § 2817.3
