Section 375:20-1-3 - General leasing guidelines and procedures
(a) Vehicles and weapons which have come into the possession of the OSBI through forfeiture or surrender of ownership may be offered for lease only at such time as legal title to these items has been vested in the Bureau.
(b) State and local law enforcement agencies shall be notified of vehicles and weapons designated by the Director for lease as these items become available. Upon notice of availability, agencies qualifying for the leasing program may contact the OSBI Headquarters for more information.
(c) Any leasing agreement reached pursuant to 375:20-1-4 and 375:20-1-5 may be renewed or terminated by the OSBI at any time. Decisions concerning renewal or termination will be wholly within the Director's discretion. Upon termination, leased items will be returned by the leasing agency to the OSBI.
(d) All agencies participating in this program shall receive a copy of the rules in this Chapter and any updates or modifications as necessary. Prior to leasing any item, agencies shall sign a statement acknowledging receipt and understanding of these rules.
(e) Pertinent information concerning all vehicles and weapons leased by the Bureau will be recorded on a hand receipt (OSBI Form S-1) prior to issue. At a minimum, the hand receipt will indicate:
(1) leasing agency including address and phone;
(2) primary hand receipt holder within the leasing agency;
(3) make/model and VIN or serial number of item;
(4) date of issue;
(5) person issuing item; and
(6) general condition of item.
(f) No property will be leased without the approval of the Director or the individual directed to manage OSBI property by the Director.
(g) OSBI shall maintain an accurate and up-to-date inventory of all items leased to agencies. OSBI shall insure agencies provide the reports required by 375:20-1-4(e) and 375:20-1-5(e) to include periodic updates concerning any changes of hand receipt holders.
(h) The leasing agency shall hold OSBI and its employees harmless from any cause of action arising from the lease relationship.
