Effective 11-1-08, the authority to "adopt, amend, repeal, and promulgate rules as may be necessary to regulate . . . home inspectors" was transferred from the Oklahoma State Department of Health to the Construction Industries Board [see 59 O.S., § 1000.4]. The Construction Industries Board promulgated emergency rules, effective 11-14-08, and later superseded those emergency rules with permanent rules, effective 7-11-09 [see OAC 158:70 and 158:10-3-5]. As of the cutoff date for this 2011 Edition of the OAC, the Department of Health had not yet revoked the rules regulating home inspectors in this Section 310:110-5-6 or in Chapter 276 [OAC 310:276].
