Section 260:135-1-17 - Service Oklahoma Operator Board(a) The "Board" means the nine (9) members of the Service Oklahoma Operator Board designated by statute (47 O.S. §3-104). (1) The members shall serve terms of two (2) years (47 O.S. §3-104).(2) At the first meeting of each calendar year, the Board shall elect from its membership a Chair and Vice-Chair to serve a one-year term.(b)Meetings.(1) Regular meetings. The Service Oklahoma Operator Board shall hold meetings as necessary in Oklahoma City, with the date, time, and location determined by the Board.(2) Special meetings. Special meetings may be called upon written notice of the Chair or by agreement of any four (4) members of the Board. Notice of a special meeting is to be delivered to all members in writing not less than forty-eight (48) hours prior to the fixed date of the meeting, unless waived.(3) Cancellation of meetings. The Chair of the Board, or the Vice-Chair in the Chair's absence, shall have power to cancel or reschedule any regular or special meeting of the Board due to anticipated lack of quorum, inclement weather, or other emergency. Notice of the cancellation of said meeting shall be posted as soon as reasonably possible and in the same manner as the agenda.(4) Members of the Board may waive formal or written notice of meeting, and by the attendance at any meeting such members so attending shall be deemed to have waived all notice thereof.(5) At least five (5) members must be present to constitute a quorum in the transaction of the Board's business and a majority vote of those present shall be necessary to approve any motion before the Board. In the absence of a quorum at any meeting, those members of the Board in attendance shall recess such meeting to any later date.(c)Committees. The Chair may appoint subcommittees and committees as deemed appropriate. Such appointments shall be in writing and may be changed as needed, upon written notice to all Board members. The Board shall make the necessary appointments to the Licensed Operator Advisory Committee, pursuant to 47 O.S. §3-105.(d)Board records; release of information. All official records of the Board shall be public records open to public inspection under reasonable circumstances at any reasonable time during business hours by any person, but such records shall not be taken from the Service Oklahoma office. Copies of public records may be obtained pursuant to the current fee schedule as adopted by Service Oklahoma.(e)Minutes of the Board. A summary shall be made of all proceedings before the Board which shall show those members present and absent, all matters considered, all actions taken, and the vote of each member on any motion. The summary shall be open to public inspection, as prescribed herein.(f)Powers and duties of the Board. The Board shall have the powers and duties set forth in Title 47 of the Oklahoma Statutes.(g)Official Records of the Board. Among other office records required by law, the Board shall maintain the following records: (1) Minutes of all meetings of the Board.(2) Records of all applicants for the issuance of a license to operate a designated Service Oklahoma location and any related decisions of the Board.(3) Records related to any action related to a Licensed Operator or a license to operate a designated Service Oklahoma location.(h) No member of the Board shall be permitted to vote on any issue in which the member has a direct financial interest.Okla.
