Section 260:130-7-5 - Methods of testimony
(a) This section shall not limit the authority of the Civil Service Division to compel witnesses allowed by these Rules to appear and offer testimony. Upon written request and approval by the ALJ, an affidavit, video conference, electronic communication, and telephone communication may be used when a witness or party is unable to attend or testify because of good reason.
(b) The parties to any action before the Civil Service Division are responsible for ensuring that the technology is available to all participants for conducting a video conference.
