Section 252:645-1-6 - Licensee's duties(a)Requirement to maintain a daily log. The Licensee shall maintain a daily log for each registered vehicle. The Licensee may keep copies of manifests or invoices in lieu of maintaining a log as long as they include the required information. The log shall include the following: (1) The total volume of septage: (A) pumped for the day and taken to: (B) taken from storage to ultimate disposal.(2) The location where the septage was pumped.(3) The name or number (permit or authorization) for the storage or disposal location utilized.(4) The name of the driver of the vehicle.(b)Information to be provided to customer. The Licensee shall inform the septic tank owner in writing of the volume of septage removed from the septic tank.(c)Pumping requirement. The Licensee shall pump all septic tanks empty, which means no more than five percent (5%) of the tank volume is left in the tank.(d)Prohibition of spillage. Septage shall be pumped into the vehicle and transported to storage and disposal locations without spillage. (e)Employee or Contractor list. Each licensee shall maintain a list of all certified drivers employed or contracted by the license holder. The licensee shall provide the list to DEQ upon request.(f)Surety bond. The licensee must document financial assurance by submitting to DEQ a surety bond guaranteeing payment or performance in the amount of Twenty-Five Thousand Dollars ($25,000.00) with the following stipulations: (1) The Licensee must be named as the principal of the bond and DEQ must be named as obligee of the bond.(2) The bond must be effective before the license can be granted by DEQ and must remain in effect as long as the Licensee is engaged in the business of pumping and transporting septage.(3) Payments made under the terms of the bond shall be made by the surety directly to DEQ. DEQ shall establish an account with these funds from which DEQ may pay for the remediation of a spill caused by the Licensee along with DEQ's costs associated with its response and oversight.Okla.
