Section 252:645-1-3 - Septage pumping and transporting licenses(a)License required. Any person operating a business that engages in pumping, transporting, or disposing of septage shall obtain an annual license from DEQ. Such licenses shall be issued to the owner, president or designated officer of the business. (b)Driver Certification. Any person employed or contracted by a licensed septage pumping and transporting business who operates a vehicle used in the pumping and transportation of septage shall comply with the requirements of this within forty-five (45) days of employment.(c)Prerequisites for license or driver certification. In order to receive an initial license or driver certification or renew a license or driver certification, an applicant must: (1) not owe any outstanding fees or fines to DEQ;(2) be in compliance with all rules promulgated by DEQ;(3) be in compliance with all final orders issued by DEQ;(4) be eighteen years of age or older; and(5) be in compliance with immigration laws of this state.(d)Application information. Applications for septage pumping and transporting licenses or driver certification shall be completed by the applicant and DEQ's local representative for the county where the business is domiciled, and then submitted to the central DEQ office. Applications shall include: (1) a completed DEQ Form 645-001 "Application for a Septage Pumping and Transporting License" that includes the registration of all vehicles used by the Applicant to pump and transport septage;(2) a completed DEQ Form 645-003 "Septage Pumping and Transporting Inspection Report" signed by the local DEQ representative;(3) documentation of the availability of an approvable disposal option; and(4) payment for applicable fees.(e)Training and examination. Applicants seeking an initial license to pump and transport septage must:(1) complete the required two (2) hours of training provided by DEQ; and(2) pass an examination with a score of at least seventy percent (70%). Any applicant found cheating on an examination: (A) will not be licensed,(B) will be subject to having any current certifications, permits and/or authorizations revoked, and(C) shall be prohibited from applying for any license, certification, permit and/or authorization for a period of twelve (12) months.(f)Examination fee. The applicant must pay to DEQ the appropriate examination fee.(g)License expiration. Septage pumping and transporting licenses and driver certifications expire on January 31 after the year of issue, unless modified by an Administrative Proceeding. (h)License renewal. A licensed and/or certified septage pumper and transporter may renew their unexpired license or driver certification by submitting the following by January 15: (1) the application information listed in 252:645-1-3(c);(2) copies of any records that are required to be kept under 252:645-5-2(m) and 252:645-7-2(h) and (i); and(3) documentation that the licensee or certified driver completed two (2) hours of approved renewal training for the license year. Renewal training credit may be granted for courses or workshops of two (2) hours or more that have been approved in writing by DEQ in advance.(i)Late renewals. The applicant shall pay a Fifty-Dollar ($50.00) late fee for renewal applications postmarked or received by DEQ after January 15.(j)Failure to renew. Any license that has not been renewed within twelve (12) months of expiring will not be renewed. Such applicants must apply for a new license.Okla. Admin. Code § 252:645-1-3
