Section 230:45-3-35 - Petition required(a) An individual who is a registered voter and who [26:8-111(B)(2)] voted in the election may request a recount in the election for a question or issue by filing a petition with the Secretary of the County Election Board as outlined in 230:45-3-1. [26:8-109; 8-111(B)(2)] In the case of a multi-county election, the petition shall be filed with the control(parent) County Election Board. The petition must meet the following requirements:(1) The petition must be signed by 150 registered voters who voted in the election if the total number of votes cast for and against the question was 15,000 or more. [26:8-111(B)(2)](2) The petition must be signed by a number of registered voters who voted in the election equal to 1% or more of the total votes cast if the total number of votes cast for and against the question was 14,999 or fewer. [26:8-111(B)(2)](b) The number of signatures required is the same whether the question requires only a majority or more than a majority for approval.Okla. Admin. Code § 230:45-3-35
