Section 165:5-1-13 - Technical failures(a) An ECF filer whose filing is made untimely as the result of a technical failure of the ECF System may seek relief from the Commission by filing a motion with the Court Clerk. If an ECF filer is unable to access the ECF System, the filer should check the Commission's website or contact the Court Clerk's Office to see if a technical failure has been declared.(b) During a technical failure of the ECF System, documents may be filed in paper or by electronic mail as authorized, directed, or instructed by the Court Clerk, the Commission rules, the User Manual, or Commission order. During a technical failure, the filer will be responsible for sending any documents to all parties of record and payment of any applicable filing fees.(c) Failures not originating with the ECF System, such as phone line problems, problems with the filer's Internet service provider, power outages, or hardware or software problems, will not constitute a technical failure under (a) above. Upon the filing of a motion, the Commission may grant appropriate relief regarding an untimely filed document.Okla. Admin. Code § 165:5-1-13
