Section 165:35-45-7 - Decommissioning, repair and repowering of wind energy facilities

(a)Decommissioning.

(1) The owner of a wind energy facility shall be responsible, at its expense, for the proper decommissioning of the facility upon abandonment or the end of the useful life of the commercial wind energy equipment in the wind energy facility. Decommissioning shall be in a manner consistent with 17 O.S. § 160.14 and 17 O.S. § 160.15.

(2) The owner of a wind energy facility shall submit to the PUD Director, a notice of decommissioning for the proper retirement of the facility upon abandonment or the end of the useful life of the commercial wind energy facility. Such notice of decommissioning shall be submitted not less than sixty (60) calendar days prior to commencement of decommissioning in a manner consistent with 17 O.S. § 160.15.

(b)Repair. When the owner of a wind energy facility determines that wind turbines or structures related to generation or battery storage must be repaired, the owner shall complete the following:

(1) Electronically submit to the PUD Director the plans to refurbish turbines or individual structures that are part of a wind energy facility.

(2) Submit all updated wind turbines or structures related to generation or battery storage information including, but not limited to, which individual turbine(s) are replaced, the new turbine manufacturer, turbine model, and the updated capacity of the facility.

(c)Repowering. When the owner of a wind energy facility determines that the facility needs to be repowered, the owner shall complete the following:

(1) Electronically submit to the PUD Director the plans to refurbish wind turbines or structures related to generation or battery storage that are part of a wind energy facility.

(2) Submit any new and/or updated forms that are filed with the FAA, Oklahoma Aeronautics Commission, and Strategic Military Planning.

(3) Submit all updated turbine and/or structure information including, but not limited to, the turbine manufacturer, turbine model, and the updated capacity of the facility.
