Section 3770:1-9-174 - Game rule number one hundred seventy-four(A) Title and term. Ohio lottery commission game rule number one hundred seventy-four, "Ohio Lottery 40th Anniversary Millions" shall be conducted at such times and for such periods as the commission may determine. For the purposes of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number one hundred seventy-four.(B) General design. (1) Game rule number one hundred seventy-four is a key number match game with an instant win feature and a "multiplier" feature and is generally known as an "instant lottery."(2) The holder of a valid ticket will remove the covering over the entire play area to reveal six "Winning Numbers," twenty-five "Your Numbers" and twenty-five corresponding prize values. If any one or more of "Your Numbers" matches one or more of the "Winning Numbers," the player wins the corresponding prize values shown below the matching "Your Numbers." If the player reveals a "2X" symbol in any of the "Your Numbers" play spots, the player wins two times the corresponding prize value shown automatically. If the player reveals a "5X" symbol in any of the "Your Numbers" play spots, the player wins five times the corresponding prize value shown automatically. If the player reveals a "10X" symbol in any of the "Your Numbers" play spots, the player wins ten times the corresponding prize value shown automatically. If the player reveals a "20X" symbol in any of the "Your Numbers" play spots, the player wins twenty times the corresponding prize value shown automatically. If the player reveals a "40th" symbol in any of the "Your Numbers" play spots, the player wins all twenty-five prizes shown automatically. There are twenty-five chances to win on each ticket, and a player may win up to twenty-five times on one ticket.(3) The only "prize values" which shall appear on a ticket in game rule number one hundred seventy-four are: ten dollars, twenty dollars, twenty-five dollars, thirty dollars, forty dollars, fifty dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, twenty thousand dollars, fifty thousand dollars, an "Annuity Prize Award" of forty thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately five hundred thousand dollars before taxes in lieu of the "Annuity Prize Award," and an "Annuity Prize Award" of four hundred thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately five million dollars before taxes in lieu of the "Annuity Prize Award." Numbers, prize values and play symbols appearing on any ticket in game rule number one hundred seventy-four shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.(C) Price of tickets. The price of a ticket issued by the commission in game rule number one hundred seventy-four shall be thirty dollars.(D) Structure, nature and value of prize awards (1) There shall be one type of prize in game rule one hundred seventy-four, a "regular prize award."(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: thirty dollars, forty dollars, fifty dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, twenty thousand dollars, fifty thousand dollars, an "Annuity Prize Award" of forty thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately seven hundred fifteen thousand seventy-two dollars before taxes in lieu of the "Annuity Prize Award," and an "Annuity Prize Award" of four hundred thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately seven million one hundred fifty thousand seven hundred twenty-four dollars before taxes in lieu of the "Annuity Prize Award." Each ticket in game rule number one hundred seventy-four shall be imprinted in such a way that prize awards from the set listed above may be won. (a) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for thirty dollars once shall win a regular prize award of thirty dollars;(b) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for twenty dollars once and ten dollars once shall win a regular prize award of thirty dollars;(c) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for ten dollars three times shall win a regular prize award of thirty dollars;(d) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for ten dollars four times shall win a regular prize award of forty dollars;(e) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for twenty dollars two times shall win a regular prize award of forty dollars;(f) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for thirty dollars once and ten dollars once shall win a regular prize award of forty dollars;(g) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for forty dollars once shall win a regular prize award of forty dollars;(h) Holder of a valid winning ticket on which a "5X" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times five shall win a regular prize award of fifty dollars;(i) Holder of a valid winning ticket on which a "2X" symbol is revealed in one of the "Your Numbers" play spots for twenty-five dollars times two shall win a regular prize award of fifty dollars;(j) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for ten dollars once and forty dollars once shall win a regular prize award of fifty dollars;(k) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for ten dollars five times shall win a regular prize award of fifty dollars;(l) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty dollars once shall win a regular prize award of fifty dollars;(m) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for ten dollars ten times shall win a regular prize award of one hundred dollars;(n) Holder of a valid winning ticket on which a "10X" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times ten shall win a regular prize award of one hundred dollars;(o) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty dollars once and on which a "2X" symbol is revealed in one of the "Your Numbers" play spots for forty dollars times two shall win a regular prize award of one hundred dollars;(p) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for twenty-five dollars four times shall win a regular prize award of one hundred dollars;(q) Holder of a valid winning ticket on which a "5X" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times five and on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty dollars once shall win a regular prize award of one hundred dollars;(r) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by three of "Your Numbers" for forty dollars once and thirty dollars two times shall win a regular prize award of one hundred dollars;(s) Holder of a valid winning ticket on which a "2X" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars times two shall win a regular prize award of one hundred dollars;(t) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for twenty dollars five times shall win a regular prize award of one hundred dollars;(u) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once shall win a regular prize award of one hundred dollars;(v) Holder of a valid winning ticket on which a "20X" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times twenty shall win a regular prize award of two hundred dollars;(w) Holder of a valid winning ticket on which a "10X" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times ten and on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once shall win a regular prize award of two hundred dollars;(x) Holder of a valid winning ticket on which a "5X" symbol is revealed in one of the "Your Numbers" play spots for forty dollars times five shall win a regular prize award of two hundred dollars;(y) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for forty dollars five times shall win a regular prize award of two hundred dollars;(z) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by four of "Your Numbers" for fifty dollars four times shall win a regular prize award of two hundred dollars;(aa) Holder of a valid winning ticket on which a "2X" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times two shall win a regular prize award of two hundred dollars;(bb) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by thirteen of "Your Numbers" for fifty dollars once, ten dollars ten times, and twenty-five dollars two times shall win a regular prize award of two hundred dollars;(cc) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for twenty dollars ten times shall win a regular prize award of two hundred dollars;(dd) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for two hundred dollars once shall win a regular prize award of two hundred dollars;(ee) Holder of a valid winning ticket on which a "20X" symbol is revealed in one of the "Your Numbers" play spots for twenty-five dollars times twenty shall win a regular prize award of five hundred dollars;(ff) Holder of a valid winning ticket on which a "40th" symbol is revealed to win all twenty-five prize awards of twenty dollars twenty-five times shall win a regular prize award of five hundred dollars;(gg) Holder of a valid winning ticket on which a "20X" symbol is revealed in one of the "Your Numbers" play spots for twenty dollars times twenty and on which one of the "Winning Numbers" is matched by one of "Your numbers" for one hundred dollars once shall win a regular prize award of five hundred dollars;(hh) Holder of a valid winning ticket on which a "10X" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars times ten shall win a regular prize award of five hundred dollars;(ii) Holder of a valid winning ticket on which a "2X" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times two and on which one or more of the "Winning Numbers" are matched by two of "Your numbers" for two hundred dollars once and one hundred dollars once shall win a regular prize award of five hundred dollars;(jj) Holder of a valid winning ticket on which a "5X" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times five shall win a regular prize award of five hundred dollars;(kk) Holder of a valid winning ticket on which a "2X" symbol is revealed in one of the "Your Numbers" play spots for two hundred dollars times two and on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one hundred dollars once shall win a regular prize award of five hundred dollars;(ll) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for fifty dollars ten times shall win a regular prize award of five hundred dollars;(mm) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by twenty of "Your Numbers" for twenty-five dollars twenty times shall win a regular prize award of five hundred dollars;(nn) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five hundred dollars once shall win a regular prize award of five hundred dollars;(oo) Holder of a valid winning ticket on which a "40th" symbol is revealed to win all twenty-five prize awards of forty dollars twenty-five times shall win a regular prize award of one thousand dollars;(pp) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by ten of "Your Numbers" for one hundred dollars ten times shall win a regular prize award of one thousand dollars;(qq) Holder of a valid winning ticket on which a "10X" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars times ten shall win a regular prize award of one thousand dollars;(rr) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by five of "Your Numbers" for two hundred dollars five times shall win a regular prize award of one thousand dollars;(ss) Holder of a valid winning ticket on which a "5X" symbol is revealed in one of the "Your Numbers" play spots for two hundred dollars times five shall win a regular prize award of one thousand dollars;(tt) Holder of a valid winning ticket on which a "2X" symbol is revealed in one of the "Your Numbers" play spots for two hundred dollars times two and on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five hundred dollars once and one hundred dollars once shall win a regular prize award of one thousand dollars;(uu) Holder of a valid winning ticket on which one or more of the "Winning Numbers" are matched by two of "Your Numbers" for five hundred dollars two times shall win a regular prize award of one thousand dollars;(vv) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for one thousand dollars once shall win a regular prize award of one thousand dollars;(ww) Holder of a valid winning ticket on which a "40th" symbol is revealed to win all twenty-five prize awards of two hundred dollars twenty-five times shall win a regular prize award of five thousand dollars;(xx) Holder of a valid winning ticket on which a "10X" symbol is revealed in one of the "Your Numbers" play spots for five hundred dollars times ten shall win a regular prize award of five thousand dollars;(yy) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for five thousand dollars once shall win a regular prize award of five thousand dollars;(zz) Holder of a valid winning ticket on which a "20X" symbol is revealed in one of the "Your Numbers" play spots for one thousand dollars times twenty shall win a regular prize award of twenty thousand dollars;(aaa) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for twenty thousand dollars once shall win a regular prize award of twenty thousand dollars;(bbb) Holder of a valid winning ticket on which a "10X" symbol is revealed in one of the "Your Numbers" play spots for five thousand dollars times ten shall win a regular prize award of fifty thousand dollars;(ccc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for fifty thousand dollars once shall win a regular prize award of fifty thousand dollars;(ddd) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for an "Annuity Prize Award" of forty thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately five hundred thousand dollars before taxes; and(eee) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" for an "Annuity Prize Award" of four hundred thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately five million dollars before taxes.(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number one hundred seventy-four will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur: (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance;(2) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per twenty-four million tickets sold should be as follows: (a) Five tickets with the winning prize combination as set forth in paragraph (D)(2)(eee) of this rule to win an "Annuity Prize Award" of four hundred thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately five million dollars before taxes;(b) Thirty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(ddd) of this rule to win an "Annuity Prize Award" of forty thousand dollars per year for twenty-five years before taxes or the "Elected Cash-Option Prize Award" of approximately five hundred thousand dollars before taxes;(c) Fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(ccc) of this rule to win fifty thousand dollars;(d) Fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(bbb) of this rule to win fifty thousand dollars;(e) One hundred twenty tickets with the winning prize combination as set forth in paragraph (D)(2)(aaa) of this rule to win twenty thousand dollars;(f) One hundred twenty tickets with the winning prize combination as set forth in paragraph (D)(2)(zz) of this rule to win twenty thousand dollars;(g) Three hundred sixty tickets with the winning prize combination as set forth in paragraph (D)(2)(yy) of this rule to win five thousand dollars;(h) Four hundred eighty tickets with the winning prize combination as set forth in paragraph (D)(2)(xx) of this rule to win five thousand dollars;(i) Six hundred tickets with the winning prize combination as hundred dollars;(tt) Three hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(l) of this rule to win fifty dollars;(uu) Six hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(k) of this rule to win fifty dollars;(vv) Three hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(j) of this rule to win fifty dollars;(ww) Six hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(i) of this rule to win fifty dollars;(xx) Six hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(h) of this rule to win fifty dollars;(yy) Three hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(g) of this rule to win forty dollars;(zz) Three hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(f) of this rule to win forty dollars;(aaa) Six hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(e) of this rule to win forty dollars;(bbb) Six hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(d) of this rule to win forty dollars;(ccc) One million five hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(c) of this rule to win thirty dollars;(ddd) One million five hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(b) of this rule to win thirty dollars; and(eee) Six hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(a) of this rule to win thirty dollars.(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.(G) Frequency of prize drawings. (1) Random imprinting of prize awards on all tickets issued in game rule number one hundred seventy-four shall be accomplished in a manner, which complies with the commission's rules and procedures.(2) When a ticket issued in game rule number one hundred seventy-four is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number one hundred seventy-four in which the ticket was sold.(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.(I) Validity of Tickets. (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number one hundred seventy-four void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.(J) Director's conduct of game rule number one hundred seventy-four. (1) The director shall conduct game rule number one hundred seventy-four and any promotions or drawings associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game and any promotions or drawings associated therewith. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number one hundred seventy-four. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.(2) Names and definitions of elements of game rule one hundred seventy-four used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number one hundred seventy-four and these elements may be given names or titles chosen by the commission.Ohio Admin. Code 3770:1-9-174
