Section 3745-266-504 - Healthcare facilities that are very small quantity generators for both hazardous waste pharmaceuticals and non-pharmaceutical hazardous waste(A) Potentially creditable hazardous waste pharmaceuticals. A healthcare facility that is a very small quantity generator for both hazardous waste pharmaceuticals and non-pharmaceutical hazardous waste may send the healthcare facility's potentially creditable hazardous waste pharmaceuticals to a reverse distributor.(B) Off-site collection of hazardous waste pharmaceuticals generated by a healthcare facility that is a very small quantity generator. A healthcare facility that is a very small quantity generator for both hazardous waste pharmaceuticals and non-pharmaceutical hazardous waste may send the healthcare facility's hazardous waste pharmaceuticals off-site to another healthcare facility, provided one of the following: (1) The receiving healthcare facility meets the conditions in paragraph (L) of rule 3745-266-502 of the Administrative Code and paragraph (B) of rule 3745-266-503 of the Administrative Code, as applicable.(2) The very small quantity generator healthcare facility meets the conditions in paragraph (A)(5)(h) of rule 3745-52-14 of the Administrative Code and the receiving large quantity generator meets the conditions in paragraph (F) of rule 3745-52-17 of the Administrative Code.(C) Long-term care facilities that are very small quantity generators. Pharmaceutical hazardous waste generated by a long-term care facility that is a very small quantity generator for both hazardous waste pharmaceuticals and non-pharmaceutical hazardous waste is exempt from rules 3745-50-40 to 3745-50-235 and Chapters 3745-52, 3745-53, 3745-54 to 3745-57, 3745-65 to 3745-69, 3745-205, 3745-256, 3745-266, 3745-270, and 3745-273 of the Administrative Code provided the long-term care facility's hazardous waste pharmaceuticals and non-pharmaceutical hazardous waste meet the following conditions: (1) The long-term care facility's hazardous waste pharmaceuticals (excluding contaminated personal protective equipment or clean-up materials) are placed in an on-site collection receptacle of an "authorized collector," as defined by the drug enforcement administration (DEA), that is registered with the DEA.(2) The on-site collection receptacle contents are collected, stored, transported, destroyed, and disposed of in compliance with all applicable DEA regulations for controlled substances.(D) Long-term care facilities with twenty beds or fewer. A long-term care facility with twenty beds or fewer is presumed to be a very small quantity generator subject to rule 3745-52-14 of the Administrative Code for both hazardous waste pharmaceuticals and non-pharmaceutical hazardous waste and is not subject to rules 3745-266-500 to 3745-266-510 of the Administrative Code, except for rules 3745-266-505 and 3745-266-507 of the Administrative Code and the other optional provisions of this rule. The director has the responsibility to demonstrate that a long-term care facility with twenty beds or fewer generates quantities of hazardous waste that are in excess of the "very small quantity generator" limits as defined in rule 3745-50-10 of the Administrative Code. A long-term care facility with more than twenty beds that operates as a very small quantity generator in accordance with rule 3745-52-14 of the Administrative Code shall demonstrate that the long-term care facility generates quantities of hazardous waste that are within the "very small quantity generator" limits as defined in rule 3745-50-10 of the Administrative Code.Ohio Admin.
