Section 3357:10-1-46 - Hazing prevention and education(A) As part of the college's commitment to providing a safe learning environment for all students, Marion technical college does not tolerate hazing by any member of the college community. This policy applies to Marion technical college students, student organizations, student groups, and employees. This policy also applies to volunteers serving in official capacity with a student organization or student group, who have direct contact with students. This policy covers conduct occurring on or off-campus, provided the hazing occurs between two or more individuals affiliated with Marion technical college.(B) Hazing, as defined by section 2903.31 of the Revised Code, means doing any act or coercing another, including the victim, to do any act of initiation into any student or other organization or any act to continue or reinstate membership in or affiliation with any student or other organization that causes or creates a substantial risk of causing mental or physical harm to any person, including coercing another to consume alcohol or a drug of abuse.(C) Additionally, hazing is intentionally, knowingly, or recklessly causing, coercing, or forcing a student to do any of the following:(1) Violating federal, state, or local law;(2) Consuming any food, liquid, alcohol, drug, or other substance that subjects the student to a risk of emotional or physical harm; or,(3) Enduring brutality of a physical, mental, or sexual nature.(D) A claim that consent was given in regard to the conduct is not a justifiable defense against a charge of hazing.(E) Individuals, organizations, or groups that have been reported for hazing will be subject to discipline through the appropriate code of conduct process, which may result in sanctions in accordance with college policy.(F) Individuals may report hazing to the college via the student conduct office and/or campus police. A reporting form is available on the college website, which will be received by the student conduct officer. All full and part-time employees of Marion technical college are mandatory reporters, and must immediately report knowledge of hazing to the student conduct officer, campus police, or office of the president.(G) Once hazing is reported, the student conduct officer will initiate an investigation and issue sanctions in accordance with AP 420 - "Student Code of Conduct and Disciplinary Action." Other college departments, including campus police, will be engaged in the investigation as necessary based on the circumstances of the incident. The student conduct officer is empowered to impose interim measures during an investigation to ensure student safety and well-being (e.g., temporary suspension of a student organization). Following the investigation, any conduct violations and subsequent sanctions against a student organization will be reported the organization's national chapter or oversight body, where applicable.(H) A report will be made to campus policy or law enforcement by the student conduct officer regarding hazing where alleged criminal activity has occurred. Criminal investigations are outside of the college's jurisdiction; however, the college will continue a separate, internal investigation of the reported hazing activity.(I) The college will maintain a report of all violations of this policy that are reported to the college within five years of the report's published date. The report will be posted to the college website on August 1st and January 1st of each academic year to include any new violations. The report will include a brief description of the alleged misconduct, findings of the investigation, and any sanctions imposed. The report will comply with the Family Educational Rights and Privacy Act of 1974 (FERPA) to exclude personally identifiable information.(J) Students who wish to join, or are part of, a student organization or student group at Marion technical college are required to complete an educational program on hazing prevention. The college will provide the opportunity for those students to complete an educational program and will also provide a copy of this policy. All students will be given the opportunity to complete the educational program on hazing prevention during new student orientation.(K) As required by state law, a copy of this policy is made available to the college community and the public via the college's public website.
