Section 1301:3-11-08 - Denial of initial application or renewal application for elevator contractor's or elevator mechanic's license(A) The superintendent may direct the division to deny an initial application for elevator contractor's or elevator mechanic's license or refuse to renew a license issued in accordance with Chapter 4785. of the Revised Code upon a finding that the applicant or licensee has done any of the following: (1) Been convicted of a "disqualifying offense," as that term is defined in paragraph (B) of rule 1301:3-11-01 of the Administrative Code, and the division determines that the license should be denied using the process described in section 9.79 of the Revised Code;(2) Violated any provision of Chapter 4105. or 4785. of the Revised Code;(3) Violated any rule adopted pursuant to Chapter 4105. or 4785. of the Revised Code;(4) Failed to meet the requirements for obtaining or renewing a license under Chapter 4785. of the Revised Code or rules promulgated thereunder;(5) Obtained or attempted to obtain a license pursuant to Chapter 4785. of the Revised Code by means of fraud, deception, or misrepresentation;(6) Obtained an order, ruling, or authorization from the division of industrial compliance by means of fraud, deception, or misrepresentation; or(7) Engaged in fraud, misrepresentation, or deception in the conduct of business.(B) A party adversely affected by an adjudication order issued pursuant to this rule shall have a right of appeal pursuant to section 119.12 of the Revised Code.Ohio Admin.
