Section 75-08-01-17 - Presumption of eligibility and significant disability1. An individual who has a disability or is blind as determined under title II or title XVI of the Social Security Act [ 42 U.S.C. 301, et seq.] and who receives social security disability insurance benefits or supplemental security income benefits is presumed to be eligible for vocational rehabilitation services if the individual intends to achieve an employment outcome.2. An individual who receives supplemental security income benefits or social security disability insurance benefits is presumed to have a significant disability.3. The presumption of eligibility described in this section shall be overcome if the division can demonstrate by clear and convincing evidence that the individual cannot benefit from vocational rehabilitation services in terms of an employment outcome because of the severity of the individual's disability. The demonstration that the individual cannot benefit from vocational rehabilitation services may be determined only after conducting trial work experiences as described in section 75-08-01-20.N.D.
