Section 75-03-36-29 - [Effective until 4/1/2024] Adoption placement1. The child-placing agency shall adopt written policies for the placement of a child free for adoption. The policies must provide for the following: a. A placement contract as specified in North Dakota Century Code section 50-12-06; b. Placement into an adoptive home as soon as possible after the child is legally free for adoption; c. Placement of an Indian child according to the Indian Child Welfare Act; d. Placement in the best interests of the child; e. Placement with relatives or extended family members if it is in the best interests of the child; f. Placing siblings together, and if this is not possible, a plan to keep separated siblings connected after adoption; g. Placement to meet each child's distinctive needs; h. Prohibition of placement based solely on the basis of race, color, or national origin of the adoptive or foster parent or the child involved; i. Continuation of services to assist the child and family; and j. Delivery of a copy of the child's current medical records to the child's adoptive parents. 2. The child-placing agency shall give notice to the department of any child placed by the child-placing agency for adoption. The child-placing agency shall provide notice within two weeks of placement on the form prescribed by the department. N.D. Admin Code 75-03-36-29
