Section 43-02-02.2-45 - Nonproduction zone monitoringThe majority of monitoring wells in nonproduction zones must be located in the down gradient direction of ground water flow in the aquifer in which the wells are completed. In addition:
1. Nonproduction zone monitoring wells must be completed in any aquifer potentially affected by injection into the production zone. These monitoring wells must be located in two general localities: a. Inside the production area; and b. Within a radius of no more than three hundred feet [91.44 meters] from the edge of the production area. 2. Monitoring wells will be spaced: a. A minimum of one well for every one acre of production area must be completed for the first overlying aquifer above the production zone; b. A minimum of one well for every three acres of production area must be completed for each additional overlying aquifer; and c. Based upon a monitoring well spacing plan approved by the department for each underlying aquifer potentially affected by injection. 3. Alternative nonproduction zone monitoring well locations may be considered if the operator demonstrates that the proposal will adequately provide monitoring coverage. N.D. Admin Code 43-02-02.2-45
