Section 43-02-02.2-33 - Corrective actions for improperly sealed wells1. Improperly sealed, completed, or abandoned wells must be corrected. The operator shall submit a plan, for department approval, that sets forth actions to be taken to prevent movement of fluid between or into water-bearing strata, including underground sources of drinking water, and otherwise into unauthorized zones. The plan must provide information on each well to be remedied, including whether it is a production, monitoring, or abandoned well; the well name or number; and a description of the well's condition. 2. In determining the adequacy of corrective plans, the department shall consider the following: a. Nature and volume of injected fluid; b. Nature of native fluids or byproducts of injection; e. History of the injection operation; f. Completion and plugging records; g. Abandonment procedures in effect at the time the well was abandoned; and h. Hydraulic connections between water-bearing strata, including underground sources of drinking water. N.D. Admin Code 43-02-02.2-33
