Section 33-24-05-895 - Conditions to qualify for and maintain the transportation and disposal conditional exemption A generator, treater, or other handler must meet the following conditions for the generator's, treater's, or other handler's eligible waste to qualify for and maintain the exemption:
1. The eligible waste must meet or be treated to meet land disposal restriction treatment standards as described in section 33-24-05-896. 2. If the generator, treater, or other handler is not already subject to nuclear regulatory commission or nuclear regulatory commission agreement state equivalent manifest and transportation regulations for the shipment of the waste, the generator, treater, or other handler must manifest and transport the waste according to nuclear regulatory commission regulations as described in section 33-24-05-897. 3. The exempted waste must be in containers when it is disposed of in the low-level radioactive waste disposal facility as described in section 33-24-05-900. 4. The exempted waste must be disposed of at a designated low-level radioactive waste disposal facility as described in section 33-24-05-899. N.D. Admin Code 33-24-05-895
