Section 1801.4 - Condemnation proceeding

Where financial assistance is to be made available or for which an application therefor has been made, the following shall be submitted to the commissioner simultaneously with an application to the court for condemnation of property:

(a) A property map showing parcels to be condemned.

(b) The resolution authorizing condemnation proceedings.

(c) An opinion of agency counsel stating that all requirements of State and local law and Title I of the Housing Act of 1949, as amended and supplemented, have been met.

(d) A copy of the petition to the court for the condemnation.

(e) If the petition does not contain a request for an order of immediate possession and/or vesting of title, an explanation of the reasons therefor.
