Section 476.2 - Appointments to certain division positions(a) The Executive Law provides for appointment to the positions of counsel, assistant counsel, division physician and assistant division physician. Applicants for such positions must be citizens of the United States, of good moral character, and must pass a physical and mental examination and be certified by a physician as qualified physically to perform the duties of the position.(b) Counsel. For appointment to this position, the applicant must be a graduate of a resident law school and a member of the bar of the State of New York, and have such other qualifications as may be determined by the superintendent.(c) Assistant counsel. For appointment to this position, the applicant must be a graduate of a resident law school and a member of the bar of the State of New York, and have such other qualifications as may be determined by the superintendent.(d) Division physician. For appointment to the position of division physician, an applicant must possess an M.D. degree, be licensed to practice in the State of New York, and have such other qualifications as may be determined by the superintendent.(e) Assistant division physician. For appointment to this position, the applicant must possess an M.D. degree, be licensed to practice in the State of New York, and have such other qualifications as may be determined by the superintendent.N.Y.
