Section 171-3.3 - Definitions(a) Privileged mail. Any item of correspondence to or from those persons (titles) or entities listed below: (1) any United States or New York State Government Official;(2) any member of the United States Congress;(3) any member of the New York State Legislature;(4) any Judge of any Federal or New York State Court; Note: This does not include Town Justice Court.
(5) the resident's attorney of record or legal representative (law guardian);(6) the commissioner of the New York State Office of Children and Family Services;(7) any deputy commissioner of the New York State Office of Children and Family Services; and(8) an ombudsman of the New York State Office of Children and Family Services.(b) Government official. The following individuals shall be considered to be government officials: (1) President or Vice President of the United States;(2) a member of the U.S. Cabinet;(3) commissioner, chief, sheriff of a police department;(4) commissioner of a State agency;(5) a deputy commissioner of a State agency; and(6) a district attorney or a representative of an assistant district attorney.N.Y.
