Section 5.58 - Executive order no. 58: naming the executive commission to transfer the functions, powers, duties and obligations of the former department of social services and the division for youth to the offices of children and family services and temporary and disability assistance

WHEREAS, Chapter 436 of the Laws of 1997 created the Department of Family Assistance, composed of two autonomous offices within the Department: the Office of Children and Family Services and the Office of Temporary and Disability Assistance;

WHEREAS, these new Offices are responsible for the functions, powers, duties and obligations of the former Department of Social Services and the former Division for Youth;

WHEREAS, the Department of Health and the Department of Labor are statutorily responsible for other functions, powers, duties and obligations of the former Department of Social Services;

WHEREAS, Chapter 436 of the Laws of 1997 established an Executive Commission responsible for developing a comprehensive legislative proposal to implement the transfer of the functions, powers, duties and obligations of the former Department of Social Services and the former Division for Youth to the appropriate successor agencies; and

WHEREAS, it is proper that such Executive Commission consist of individuals with the expertise, judgment and professional knowledge needed to develop a comprehensive legislative proposal;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby order as follows:

I. Executive Commission

There is hereby named an Executive Commission to develop a comprehensive legislative proposal to implement the transfer of the functions, powers, duties and obligations for the former Department of Social Services and the former Division for Youth to the appropriate successor agencies.

The Executive Commission shall consist of the Commissioner of the Office of Children and Family Services, or his designee; the Commissioner of the Office of Temporary and Disability Assistance, or his designee; the Commissioner of the Department of Labor, or his designee; the Commissioner of the Department of Health, or her designee; the Director of State Operations, or his designee; the Counsel to the Governor, or his designee; the Director of the Division of the Budget, or her designee; and the Executive Director of the Council on Children and Families, or her designee.

Members of the Commission shall receive no compensation but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties.

II. Powers and Responsibilities of Commission

The Executive Commission shall develop a comprehensive legislative proposal or proposals implementing the transfer of the functions, powers, duties and obligations of the former Department of Social Services and the former Division for Youth to the appropriate successor agencies, consistent with the provisions of Chapter 436 of the Laws of 1997.

The Executive Commission shall submit such legislative proposal or proposals to the Governor, the Temporary President of the Senate and the Speaker of the Assembly as soon as practicable.

III. Staff Support and Cooperation of State Agencies

The departments represented on this Executive Commission and any other State agencies, divisions, offices or departments shall cooperate fully with the Commission and its mission. Such assistance may include, but shall not be limited to, the use of agency staff and other administrative and technical resources necessary for the Commission to fulfill its mission, including the provision of statistical and policy data in such form as is requested by the Commission.

IV. Dissolution

The Executive Commission shall be dissolved ninety days after completion of its final legislative proposal fully implementing the transfer of the functions, powers, duties and obligations of the former Department of Social Services and the former Division for Youth to the appropriate successor agencies.
