Section 5.41 - Executive order no. 41: establishing a task force to analyze federal welfare reform

WHEREAS, the federal government has enacted federal welfare reform legislation entitled the "Personal Responsibility and Work Opportunity Reconciliation Act of 1996";

WHEREAS, this legislation represents an historic opportunity to restructure a failed welfare system which has become a way of life for too many New Yorkers;

WHEREAS, welfare should instead be a transitional means of support for needy New Yorkers;

WHEREAS, however, the State of New York may be adversely affected by the shifting of costs of Medicaid and health care from the federal government to state and local governments under this legislation.

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby create the Task Force to Analyze Federal Welfare Reform (the "Task Force"). The Task Force shall be chaired by the Director of the Division of the Budget and shall include the Commissioners of Social Services, Health and Labor; the Director of State Operations; the Temporary President and Majority Leader of the Senate, the Speaker of the Assembly, the Minority Leader of the Senate and the Minority Leader of the Assembly, or their designees; the Mayor of the City of New York or his designee; and a member designated by the New York State Association of Counties.

1. The Task Force shall:
a. Review and analyze the policy and fiscal implications for the State of New York of Federal welfare legislation, entitled "Personal Responsibility and Work Opportunity Reconciliation Act of 1996", specifically including the shifting of medicaid and health care costs from the Federal government to the State and local-governments; and
b. Through the Chairman, present to the Governor recommendations for any legislative or regulatory changes necessary to comply with and implement Federal welfare legislation in the best interests of all New Yorkers.
2. The members of the Task Force shall receive no compensation but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their duties.
3. Every state department, agency, division, board, bureau, commission, and any other entity over which I have executive power shall provide any assistance necessary for the Task Force to carry out its duties.
