Section 5.25 - Executive order no. 25: establishing a task force on state work force management and employee deployment

WHEREAS, the planned reduction of the State work force does not eliminate the need to fill critical position vacancies in order for the State to fulfill its mission;

WHEREAS, a centrally coordinated method of identifying, assessing and managing position vacancies across all State agencies is essential for prudent deployment of the State work force;

WHEREAS, more flexible deployment of the State work force would assist in avoiding or mitigating the involuntary separation of employees;

WHEREAS, privatization of certain State assets or contracting out certain State functions or services may create the need to find alternative employment opportunity for affected employees;

WHEREAS, current State law, rules or regulations may impede the flexibility necessary to manage the reduction and redeployment of the work force; and

WHEREAS, effective management of State position vacancies is required to provide mandated and necessary State services with the optimal staffing levels needed for the delivery of those services;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby order as follows:

I. Task Force on State Work Force Management and Employee Deployment

There is hereby created the Task Force on State Work Force Management and Employee Deployment. The Task Force shall be chaired by the Director of State Operations and shall include the Directors of the Office of Employee Relations and Division of the Budget, the Commissioners of the Departments of Civil Service and Labor and such other members as the Director of State Operations shall deem appropriate. Members of the Task Force shall receive no extra compensation beyond that provided in their current State positions, but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance of their Task Force duties.

II. Powers and Responsibilities of the Task Force

The Task Force shall make recommendations for coordinating and facilitating State agencies' efforts to: identify vacancies and opportunities for redeployment to those vacancies; maximize comparability determinations to assist redeployment; identify retraining opportunities that offer potential reemployment for affected employees; provide necessary job placement, counseling, and job search services to employees; implement State agency staff reduction efforts including the use of various separation incentives that may be available; and within the context of the above, manage the State work force to reflect the most prudent use of existing employees.

The Task Force shall identify any modifications to laws, rules or regulations as necessary to carry out its recommendations.

III. Cooperation of State Agencies

The Director of State Operations shall be responsible for assuring that State agencies, departments, divisions, boards or offices shall cooperate with and provide such assistance as may be requested by the Task Force.
