Section 5.120 - Executive order no. 120: establishing the task force on military bases in new york state

WHEREAS, the U.S. Department of Defense has begun the process of reviewing the structure of the national military force and developing goals in relation to existing military bases throughout the country;

WHEREAS, pursuant to the National Defense Authorization Act for the current 2002 fiscal year, the Federal government will institute a round of base closures and realignments in 2005;

WHEREAS, military bases in New York State are critical to the defense of the nation and freedom around the world, and serve as an important source of economic stability and pride to the communities in which they are located;

WHEREAS, these military bases conduct a wide array of operations involving the Air Force, Army, Navy and Marines, including the National Guard and reservists;

WHEREAS, local base support organizations in New York State continue to work at the Federal, State and local levels to retain and expand New York's military bases;

WHEREAS, the State of New York must continue efforts to retain and improve military installations in the State by working cooperatively with local governments and local base support organizations in order to use resources and provide support effectively and efficiently;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, do hereby establish the Task Force on Military Bases in New York State.

I. Membership

The Task Force on Military Bases in New York State (Task Force) shall consist of members who shall be appointed by, and serve at the pleasure of, the Governor. Members of the Task Force shall serve personally or through a designee and shall include: the Chairman and Commissioner of Empire State Development Corporation, who shall serve as Chair; the Secretary of State; the Adjutant General of the New York State Division of Military and Naval Affairs; the Commissioner of the New York State Department of Transportation; the Chairman of the New York State Power Authority; the President of the New York State Energy Research Development Authority; the Commissioner of the New York State Division of Housing and Community Renewal; the Chancellor of the State University of New York; the Executive Director of the New York State Thruway Authority; the Commissioner of the Department of Environmental Conservation; the President of the New York State Environmental Facilities Corporation; the Director of the New York State Office for Federal Affairs; the Superintendent of the New York State Police; the Executive Director of the Niagara Frontier Transportation Authority; and such other members as the Governor shall deem appropriate. The members of the Task Force and/or their designees shall receive no compensation, but shall be entitled to reimbursement for any necessary expenses incurred in connection with the performance for their Task Force duties.

II. Responsibilities and Powers
A. The Task Force shall:
(1) work cooperatively with local governments and local base support organizations to identify ways in which support and resources can be utilized for the retention of existing bases and for the expansion of these facilities in the event of closures or consolidations elsewhere;
(2) identify State resources that can be utilized to aid military missions, improve base operations and quality of life for military base personnel and their dependents, in relation to: roads; air and water accessibility; research, testing, training, storage and other facilities; adult and child education; health care; industry and economic concerns; power and energy concerns; housing and community development; environmental concerns; technology issues; and in relation to any other issue deemed appropriate by the Chair of the Task Force;
(3) consult with experts as necessary and call upon any agency, department, office, division, or public authority of this State to supply it with such data and other resources, personnel and assistance as the Task Force deems necessary to discharge the responsibilities conferred upon it by this Order;
(4) provide periodic reports to the Governor on any major actions or efforts to be undertaken by the Task Force and report to the Secretary to the Governor on the status of all Task Force business and initiatives; and
(5) supply relevant data and information to the Base Realignment and Closure Commission and/or appropriate Federal officials indicating that military bases in New York State are critical to the defense of the nation and serve as an important source of economic stability and pride to the communities in which they are located.
III. Cooperation of State Agencies

Each agency, department, office, division, or public authority of this State is hereby required to cooperate with the Task Force and to furnish the Task Force with such information, personnel, and assistance as the Task Force deems necessary to accomplish the purposes of this Order.
