Section 5.104 - Executive Order No. 104: Appointing a Special Advisor to Evaluate the Fiscal Condition of the County of Nassau. [*]

WHEREAS, the State of New York has a compelling interest in the fiscal condition of its counties and other political subdivisions;

WHEREAS, it has been reported that the County of Nassau is experiencing fiscal difficulty that may, if not remedied, adversely affect the County and its residents; and

WHEREAS, there is a demonstrated need for the State to conduct an independent evaluation of the fiscal condition of the County of Nassau;

NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State of New York, including section six of the Executive Law, do hereby appoint Frank G. Zarb as Special Advisor to Evaluate the Fiscal Condition of the County of Nassau.

The Special Advisor shall evaluate the fiscal condition of the County of Nassau, including the nature, extent and causes of any fiscal problems, and advise the Governor in relation to such matters as quickly as is reasonably practicable. I hereby give and grant to the Special Advisor the powers and authorities which may be given or granted to persons appointed by me for such purpose under authority of section six of the Executive Law and any other applicable provision of law.

The Special Advisor may employ such counsels, deputies, officers and staff and other persons as he may require and fix their compensation within the limits of funds available therefor, and he shall also have the power to contract with outside consultants for assistance. The Special Advisor and any counsels, deputies, officers and staff shall be reimbursed for all actual and necessary expenses incurred in the performance of their official duties.

Every department, division, board, bureau, agency, council, authority, public benefit corporation and political subdivision of the State shall provide every assistance, facility and cooperation which may be necessary or desirable for the accomplishment of the duties assigned to the Special Advisor.
