Section 3.92 - Executive Order No. 92: Establishing the New York State Office of Development Planning

I, Hugh L. Carey, by virtue of the authority vested in me by the Constitution and the laws of the State of New York, and as Governor of the State of New York, by Executive Order do hereby establish in the Executive Department, Office of the Governor, an Office to be known as the New York State Office of Development Planning to coordinate planning and development activities of State agencies, and to insure greater consistency between and among functional development planning efforts and Administration policy.

General Powers and Duties

It is the policy of the State in meeting public needs to establish coordinated and consistent planning and development programs, policies and priorities to achieve sound and balanced growth and development, the effective and efficient use of the State's resources and a strengthened State economy.

To assist in carrying out the foregoing policy, the New York State Office of Development Planning shall:

- Identify and analyze for the Governor the major development factors affecting the State's future.

- Assist in the formulation of coordinated State policies, plans and programs addressing these major factors, as they affect the State's development.

- Undertake, as the Governor may direct, any studies, research, inquiries or analyses necessary for the development, coordination or implementation of State policies, plans and programs.

- Promote the efficient utilization of the State's resources, through coordination of State agency plans/and programs, and the direction of interagency planning and development.

- Support coordination of the sub-cabinet structure with agency policy planning functions.

- Coordinate State policies related to Federal and interstate/multistate planning and development issues, intitiatives, legislation and organizations.

- Review and undertake policy analysis of federal legislation related to the development potential of the State.

- Act as the State's economic development planning agency pursuant to Public Law 89-136 (Public Works and Economic Development Act of 1965), together with any act or acts amendatory or supplemental thereto, and any regulations promulgated thereunder, and to do all things necessary or convenient to fulfill the purposes and requirements of such act or acts including receiving and disbursing funds made available under such act or acts.

- Participate in other federal planning programs, as the Governor may direct.

Amendment of Prior Order, Effective Date and Transfer Provisions

Executive Order Number 73, dated July 12, 1978 reestablishing the New York State Economic Development Board and transferring certain functions, powers, duties and obligations formerly possessed by such Board to the New York State Department of Commerce is hereby amended; and, effective immediately, all of the functions, powers, duties and obligations transferred to the New York State Department of Commerce by such Executive Order relating to the duties of the New York State Department of Commerce to oversee and coordinate economic development planning activities in the State and to act as the State's economic development planning agency pursuant to Public Law 89-136 (Public Works and Economic Development Act of 1965, as amended), and all duties incidental thereto, shall be transferred and assigned to, assumed and devolved upon the New York State Office of Development Planning; and all of the rights and obligations of the New York State Department of Commerce under any contract or agreement relating to such functions, powers, duties and obligations to which the New York State Department of Commerce is a party, are hereby transferred, and assigned to, devolved upon and assumed by the New York State Office of Development Planning.

With respect to the functions, powers, duties and obligations so transferred and assumed, the New York State Office of Development Planning shall be deemed and be held to constitute the continuation of the New York State Department of Commerce for those purposes and not a different board, agency or authority. Any proceeding or other business or matter heretofore undertaken or commenced by or before the New York State Department of Commerce relative to the functions, powers, duties and obligations herein transferred to and assumed by the New York State Office of Development Planning may be conducted and completed by the New York State Office of Development Planning in the same manner and under the same conditions and with the same effect as if conducted and completed by the New York State Department of Commerce.

All Federal funds available to the New York State Department of Commerce for the performance of the functions, powers, duties and obligations transferred and assigned to the New York State Office of Development Planning pursuant to this Executive Order, to the extent remaining unexpended or unencumbered, shall be transferred to and made available for use by the New York State Office of Development Planning for the same purposes for which originally provided.
