Section 3.75 - Executive Order No. 75: Creating a task force on transportation of the disabled and directing the development of a comprehensive plan for the transportation of the disabled

Whereas, it is the policy of the State of New York to serve the needs of disabled persons, wherever possible and practicable, in the least restrictive environment consistent with their needs; and

Whereas, this policy of the State has been manifested in the ongoing development of a network of community-based services to serve the needs of disabled persons; and

Whereas, full utilization of existing services by disabled persons is impaired by inadequate transportation facilities available to them; and

Whereas, transportation plays a vital role in enabling disabled persons to derive the full benefits of the resources of a community:

Now, therefore, I, Hugh L. Carey, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and laws of this State, do hereby create a Task Force on Transportation of the Disabled, which shall be composed of the Advocate for the Disabled, the Commissioners of Transportation, Social Services, Mental Health, Mental Retardation and Developmental Disabilities, Aging, the Chairman of the State Commission on Quality of Care for the Mentally Disabled, the Director of the Division of Alcoholism and Alcohol Abuse, the Director of the Division of Substance Abuse Services, and eight persons appointed by the Governor. The persons appointed by the Governor shall be broadly representative of the State's disabled population and shall include disabled persons and representatives of non-State agencies serving the disabled. The Governor shall designate one of the members of the Task Force as chairman and one as vice-chairman. The appointed members of the Task Force shall receive no salary but shall be reimbursed for their actual and necessary expenses.

As used herein, the term disabled shall mean a person who has or is perceived to have substantial developmental, sensory, physical, emotional or other impairments or disabilities which adversely affect the person's ability to function.

The Task Force shall meet at regularly scheduled intervals at the call of the chairman.

The Task Force on Transportation of the Disabled shall:

(1) Consult with any Federal, State, local or private or nonprofit organization concerned with the needs of the disabled, conduct conferences, workshops and public information programs, obtain such information and assistance from State agencies as may be necessary to enable the Task Force to fulfill the requirements of this order;
(2) Identify existing transportation services and facilities available to disabled persons in each region of the State;
(3) Identify present needs for transportation services and facilities for disabled persons in each region of the State;
(4) Establish an order of priority for the development of transportation services and facilities for disabled persons to meet current and future needs in each region of the State;
(5) Develop and submit to the Governor and the Legislature by March 31, 1979 a comprehensive plan for the development of such transportation facilities and services for disabled persons as are needed in each region of the State, taking into account the particular needs of urban and rural areas. The plan shall:
(a) identify specific measures to be undertaken to implement the recommendations contained therein;
(b) recommend assignment of responsibility for development of needed services and facilities to the most appropriate agency, including a State or local government agency or authority or public benefit corporation;
(c) estimate the costs of implementation of the plan, identifying, to the extent reasonably practicable, sources of revenue, whether Federal, State, local or private, available for the implementation of the plan.
