Section 3.39 - Executive order no. 39: establishing a new york state board of tourism

WHEREAS, The tourism industry is an important segment of the State's economy contributing greatly to employment income and tax revenues; and

WHEREAS, Tourism directly or indirectly affects a broad range of related businesses and industries within the State; and

WHEREAS, Improvement and encouragement of tourism can have a significant beneficial impact upon the State's economy;

NOW, THEREFORE, I, Hugh L. Carey, Governor of the State of New York, by virtue of the authority vested in me by the Constitution and Laws of the State, do hereby establish a New York State Board of Tourism in the Department of Commerce to stimulate, develop, expand and promote tourism and related businesses and industries in the State as a means of revitalizing the State's economy in this respect by the creation of new job opportunities, an expanded tax base and by a reduction in the level of unemployment.

I. Functions, Powers and Duties.

The board shall:

1. Develop administrative and legislative recommendations, including specific recommendations as to how money appropriated for tourism is to be expended;
2. Propose methods of advertising and promotion of the State's tourism industry and of improvement of tourist facilities and attractions;
3. Develop a long-range marketing plan for attracting tourists to New York;
4. Identify all Federal programs related to tourism and make recommendations concerning such programs for the benefit of the State;
5. Facilitate coordination of efforts between and among State, local and Federal governments and private industry for the attraction of tourists to this State;
6. Recommend programs to provide technical assistance by the Department of Commerce to those persons interested in developing a tourist industry business in this State;
7. Prepare an annual report to the Governor indicating specific accomplishments and recommendations with respect to achieving objectives in each specific area of responsibility set forth herein.
II. Composition and Compensation.

The board shall be comprised of the Commissioner of Commerce, the Commissioner of Transportation, the Commissioner of the Office of Parks and Recreation, the chairman of the Council on the Arts, the chairman of the Thruway Authority and 15 members to be appointed by the governor.

Members shall be appointed for a term of one year. The Commissioner of Commerce shall be the chairman of the board and he shall designate a vice-chairman from among the members to serve at his pleasure.

The members of the board shall not receive any salary or other compensation but shall be reimbursed for expenses incurred in the performance of their duties within amounts made available therefor by appropriation. Reimbursement for such expenses shall be made only upon authorization of the Commissioner of Commerce.

The appointment of any member who is unable to attend three consecutive meetings or who otherwise is absent from half of the meetings of the board in any one year shall automatically be terminated. Any vacancies resulting from such automatic terminations shall be filled for the unexpired portion of the term by the Governor.

The board shall have at least four meetings a year.

III. Personnel.

The Commissioner of Commerce shall designate such employees of the Department of Commerce as may be necessary and appropriate in his opinion to assist the board and coordinate its activities with the Department of Commerce. No employee shall receive any additional compensation therefor.
