Section 3.108 - Executive Order No. 108: Declaring an emergency in the city of Port Jervis and the town of Deer Park and directing State agencies to assist authorities in guaranteeing public safety and protecting property

WHEREAS, Over the period of February 11th-12th weather conditions resulted in ice jams on the Delaware River which caused flooding and serious damage in the city of Port Jervis and the town of Deer Park and required the evacuation of a substantial number of homes in those areas, and the city of Port Jervis and the town of Deer Park require the assistance of State government to respond to the danger posed by the ice jams;

NOW, THEREFORE, I, Hugh L. Carey, Governor of the State of New York, do hereby find that a disaster has occurred for which local governments are unable to respond adequately, and therefore I hereby declare, by virtue of the authority vested in me by the Constitution, the Laws of the State of New York, and section 28 of article 2B of the Executive Law, a disaster emergency, effective February 12, 1981, within the city of Port Jervis and the town of Deer Park.

Further, pursuant to section 29 of article 2B of the New York State Executive Law, I authorize, effective February 12, 1981, State agencies to take such action as necessary to assist the aforementioned city and town to guarantee the public safety and the protection of property.
