Section 2200.2 - Definitions

As used in this Subchapter, the following terms shall have the following meanings, unless otherwise specified:

(a) General awards means:
(1) tuition assistance program (TAP) awards;
(2) Regents awards for children of deceased and disabled veterans;
(3) Regents awards for children of deceased State correction officers and State civilian employees of a correction facility; and
(4) tuition awards for Vietnam veterans.
(b) Academic perforamance awards means:
(1) Regents college scholarships;
(2) Regents professional education in nursing scholarships;
(3) Regents professional education in medicine, dentistry or osteopathy scholarships;
(4) Regents professional education in optometry scholarships;
(5) Regents physician shortage scholarships;
(6) Regents veterans with war service scholarships;
(7) Empire State challenger scholarships for teachers;
(8) Empire State challenger fellowships for teachers;
(9) Regents health care professional opportunity scholarships;
(10) Regents professional opportunity scholarships;
(11) Regents physician loan forgiveness program;
(12) Empire State scholarships of excellence; and
(13) Liberty scholarships.
(c) Fellowships means Herbert L. Lehman graduate fellowships in the social sciences and public and international affairs.
(d) Term. For purposes of determining a schedule of payment of awards under this Subchapter, term shall mean a unit of attendance, including but not limited to quarter, semester; uniterm (24 semester hours for an academic year of not more than 12 months), as established by the corporation.
(e) Regular academic year, as it affects the determination of term structure for computing the proper manner of payment of awards and payment for summer study, shall mean that period of attendance normally utilized by collegiate level institutions encompassing two semesters of study or the equivalent as determined by the commissioner, excluding the summer term.
(f) Cost of attendance. As used hereinafter, the following terms shall have the following meanings, as components of an award recipient's cost of attendance:
(1) Tuition shall mean the actual tuition charged to an award recipient by the institution he or she is attending.
(2) Required fees shall mean educational fees as defined by the commissioner.
(3) Books shall mean a reasonable amount, determined by the institution, of an award recipient's cost of books for an academic year.
(4) Transportation shall mean a reasonable amount, determined by the institution, of an award recipient's cost for transportation for an academic year. This amount may include:
(i) the cost of travel between the award recipient's residence and the institution; and
(ii) the cost of travel required for completion of a course of study.
(5) Room and board shall mean an amount calculated as follows:
(i) for a student who has no dependents and lives with his or her parent(s), an allowance of $1,100;
(ii) for a student who has no dependents and lives in institutionally owned or operated housing, the actual amount charged the student for room and board for an academic year;
(iii) for a student who has no dependents and does not live with his or her parent(s) or in institutionally owned or operated housing, a standard allowance, determined by the institution, for room and board for an academic year; or
(iv) for a student who has dependents, an allowance, determined by the institution, for room and board for an academic year based upon expenses incurred by the student and his or her dependent(s).

For purposes of this section, a spouse is considered a dependent.

(6) Laboratory and other instruction-related expenses shall mean a reasonable amount, determined by the institution, of an award recipient's costs for laboratory and other instruction-related expenses, which shall include but not be limited to laboratory fees and the cost of all equipment and material which is required by the institution for the completion of any course considered part of the approved program of an award recipient.
