Section 310.1 - Participation of state-operated campuses in interinstitutional arrangements

The chancellor, or his designee, is authorized to approve the participation of the university and any State-operated campus, through contract or otherwise, in interinstitutional arrangements providing for voluntary cooperative operation or use of facilities and academic resources among nonpublic and public institutions of higher education, on a regional basis, including any cooperative association of such educational institutions formed as a corporation, in accordance with further guidelines as shall be developed and issued by the chancellor with the approval of the Director of the Budget, provided that:

(a) the chancellor, or his designee, shall review and approve the terms and conditions of participation in any interinstitutional corporation, including the charter and bylaws thereof, and may thereafter authorize a chief administrative officer of a State-operated campus, or his designee, to participate on the governing body of such a corporation;
(b) the university's commitments, including facilities and resources, to any interinstitutional arrangement, association or corporation shall be made in compliance with all provisions of law and regulations governing the university and shall not exceed funds appropriated or otherwise lawfully available to the university therefor in the fiscal year in which the commitments are made and so certified by the Director of the Budget;
(c) the financial standing and operations of any interinstitutional arrangement, association or corporation shall be subject to post-audit by the State Comptroller; and
(d) an annual report of any interinstitutional arrangement, association, or corporation shall be submitted to the chancellor.
