Section 170.6 - Flexible paymentsIn any school year in which the statewide total of the flexible payments to be paid in the months of December through March, pursuant to subdivision (1) of section 3609 of the Education Law, exceeds the amount appropriated for such purpose, such flexible payments shall be reduced as follows:
(a) No later than December 1st of each year, the commissioner will calculate the statewide total of such payments based upon data available as of the date of the commissioner's calculation.(b) The appropriation for general support for public schools, excluding appropriations for special programs, which remains available after making prescribed payments, pursuant to paragraph a of subdivision (1) of section 3609 of the Education Law, will be divided by such statewide total of flexible payments, and the result will be expressed as a decimal carried to five places without rounding.(c) If such decimal is equal to or greater than one, no reduction of appropriations shall be made. If such decimal is less than one, each school district's allocations to be made in the months of December through March shall be reduced to the amount calculated by multiplying by such decimal the amount it would be entitled to receive if no reductions were necessary.N.Y.
