Section 167.3 - Approval requirements(a) No agency shall be permitted to provide basic skills programs under SECGP or to provide basic skills programs for youth under JTPA title II unless it approved by the department or exempted from such approval pursuant to section 167.4 of this Part.(b) In order to be eligible for approval to operate a basic skills program, an agency shall: (1) be incorporated or chartered and have conducted a basic skills program for the two years immediately preceding the date of application for approval;(2) provide a statement from a certified public accountant or public accountant that its fiscal procedures are consistent with standard fiscal practices;(3) have engaged in consultation and cooperative arrangements with other public and private agencies for the delivery of programs and/or services; and(4) have a faculty of which a majority have at least two years experience in teaching basic skills.(c) The commissioner may suspend or withdraw such approval for failure to comply with institutional or program requirements and standards as required by this Part.N.Y.
