Section 145-7.3 - Average nontuition costs of attendance

The commissioner, in consultation with the President of the Higher Education Services Corporation and subject to the approval by the Director of the Budget, shall determine each year the average of all nontuition costs of attendance at the State University of New York to be used for full-time and part-time students, as those costs relate to the Liberty Scholarship Program. The regular academic year room and board liberty allowances shall be determined each year by the commissioner based on information certified by the State University of New York no later than July 1st preceding the regular academic year. The components of the average nontuition costs of attendance are the costs of room and board, transportation, and books and supplies. Each component shall be determined as follows:

(a) Room and board liberty allowance.
(1) Full-time students:
(i) Resident student (public institutions). The room and board liberty allowance shall be the lesser of (a) the cost of a double room and full meal plan (if offered) at the institution attended, or (b) the actual room and board charge to the student for the period of attendance. If an institutional meal plan is not offered, the liberty allowance for board shall be the average cost of a full meal plan at the State University of New York for the period of attendance.
(ii) Resident student (nonpublic institutions). The room and board liberty allowance shall be the lesser of (a) the average cost of a double room and full meal plan at the State University of New York, or (b) the actual room and board charge to the student for the period of attendance. If an institutional meal plan is not offered, the liberty allowance for board shall be the average cost of a full meal plan at the State University of New York for the period of attendance.
(iii) Off-campus student (public institutions). The room and board liberty allowance shall be the average cost of a double room and full meal plan at the institution attended for the period of attendance. If room is not offered at the institution attended, the liberty allowance for room shall be the average cost of a double room at the State University of New York for the period of attendance. If an institutional meal plan is not offered at the institution attended, the liberty allowance for board shall be the average cost of a full meal plan at the State University of New York for the period of attendance.
(iv) Off-campus student (nonpublic institutions). The room and board liberty allowance shall be the lesser of (a) the average cost of a double room and full meal plan at the State University of New York, or (b) the average cost of a double room and full meal plan at the institution attended for the period of attendance. If room is not offered at the institution attended, the average cost of a double room at the State University of New York shall be used to determine the liberty allowance for room for the period of attendance. If an institutional meal plan is not offered at the institution attended, the average cost of a full meal plan at the State University of New York shall be used to determine the liberty allowance for board for the period of attendance.
(v) Commuter student. The regular academic year room and board liberty allowance for a student residing with parent(s), or in a dwelling owned or rented by his or her parents, shall be the average cost of a full meal plan at the State University of New York. The regular academic year room and board liberty allowance for a student not residing with parent(s), or in a dwelling owned or rented by his or her parents, shall be the average cost of a full meal plan at the State University of New York plus the difference under the Federal Pell Program between the amount provided to a student without dependents residing at home with parent(s) and the amount provided to any other student. The weekly room and board liberty allowance for accelerated term students shall be one-thirtieth of the next regular academic year room and board liberty allowance for commuter students at the institution attended.
(2) Part-time students. The regular academic year room and board liberty allowance for all part-time students shall be the average cost of a full meal plan at the State University of New York. The weekly room and board liberty allowances for accelerated term students shall be the weekly average cost of a full-meal plan at the State University of New York for the period attended.
(b) Transportation liberty allowance. The regular academic year transportation liberty allowances for full-time and part-time "resident, off-campus and commuter" students at institutions of The City University of New York and the State University of New York shall be determined each year by the commissioner based on information certified by the respective universities no later than November 1st preceding the award year. The regular academic year transportation liberty allowances for students at all other institutions shall be the average student financial aid transportation allowances at the State University of New York. The weekly transportation liberty allowances for accelerated term shall be one-thirtieth of the next regular academic year transportation liberty allowances at the institution attended.
(c) Books and supplies liberty allowance.
(1) Full-time students. The regular academic year books and supplies liberty allowance for all full-time students shall be determined each year by the commissioner based on information certified by the State University of New York no later than November 1st preceding the award year. The books and supplies liberty allowance for a full- time accelerated term student shall be one-half the next regular academic year full-time student books and supplies liberty allowance at the institution attended.
(2) Part-time students. The regular academic year books and supplies liberty allowance for a three-quarter-time student (enrolled for at least nine but less than 12 semester hours) shall be 75 percent of the amount for full-time students. The books and supplies liberty allowance for a three-quarter-time accelerated term student shall be 50 percent of the next regular academic year three-quarter-time student books and supplies liberty allowance at the institution attended. The regular academic year books and supplies liberty allowance for half-time students (enrolled for at least six but less than nine semester hours) shall be 50 percent of the amount for full-time students. The books and supplies liberty allowance for a half-time accelerated term student shall be 50 percent of the next regular academic year half-time student books and supplies liberty allowance at the institution attended.
