This Part does not affect the authority of the Department of Agriculture and Markets. The Department of Agriculture and Markets shall inspect registered growers and dealers of plant material pursuant to Agriculture and Markets Law, article 14 section 166, for compliance with this Part. Any violation issued by the Department of Agriculture and Markets shall be referred to the Department of Environmental Conservation for assessment of penalties pursuant to Environmental Conservation Law, section 71-0703.
