Section 383-14.3 - Security requirements through the institutional control periodThe following requirements apply from the effective date of the initial permit until the end of the institutional control period:
(a) The permittee must provide and maintain: (1) a fence or other barrier capable of preventing unauthorized entrance that completely surrounds the land disposal facility;(2) a means to control entry, at all times, through gates or other entrances to the land disposal facility;(3) vehicle(s) for patrolling and controlling the land disposal facility boundary;(b) The permittee must post signs in sufficient numbers at each entrance to the land disposal facility and at other locations so that they are visible from any approach to the land disposal facility. The signs must contain a legend that is legible from a distance of at least 25 feet and contain a warning that:(1) only authorized personnel are allowed to enter the land disposal facility;(2) unauthorized entry onto the land disposal facility can be dangerous; and(3) radioactive wastes are present at the land disposal facility.(c) On a case-by-case basis, the department may approve the use of portions of the land disposal facility for activities that are not related to waste disposal if the proposed use will not: (1) interfere with the operation of the land disposal facility;(2) adversely affect the public health and safety and the environment; or(3) adversely affect the ability of the land disposal facility to meet the applicable requirements in this Part and Part 382 of this Title.N.Y.
